Compatible Independent Implementations of the Java SE platform spec must pass the TCK, so the TCK must be licensed from the Spec Lead.  Spec Leads currently are not required to make a TCK license public and can offer different implementers different confidential licenses.  The information available to the EC about TCK licensing can be very vague.  As part of evaluating this JSR, we asked whether any terms would restrict or limit creation or distribution of Independent Implementations of the Java SE platform for implementations that are able to meet the 3 compatibility conditions (including passing the TCK).  We also asked whether a TCK license would be promptly offered for evaluation to anyone who requested one.  We did not feel our questions were answered directly enough to vote on the JSR so we abstained.
