We thank the Spec Lead for making their licenses publicly viewable. We don't see any field of use restrictions on implementations tested in their TCK License. 

The JSR says "The Discovery API will be made available to the public under exactly the same terms and conditions as all other OSS/J APIs, which is called the OSS/J Harmonized Licensing and Certification Model. The agreements for the Specifications, the Reference Implementations and the TCKs can be viewed by downloading any OSS/J API."  It would be easier for community review if URLs for licenses were included rather than to have to find them.  e.g. we looked at http://www.tmforum.org/browse.aspx?catID=4037&docID=6809
for the TCK License.

IBM's vote is based on the technical merits of this JSR and is not a vote on the licensing terms.  IBM supports licensing models that create an open and level playing field by allowing third parties to create independent implementations of Java Specifications and that do not allow individuals or companies to exercise unnecessary control for proprietary advantage.  We support open source as a licensing model for contributions in the JCP, and would hope others will support this direction. This comment is not necessarily directed at the current business or license terms for this JSR, however, it is a statement of IBM's preferred licensing model.
