Technically there is nothing in this JSR that is of concern, and in that aspect there is nothing preventing for voting YES. However, the issue raised by IBM is worth pointing out and it requires attention. Thus, the decision of abstaining from voting.

IBM have no technical concern with the JSR; however, we feel that we could not agree to the proposed license terms in two areas:   

In paragraph 2.2 (v) in the indemnification statement, we have difficulty with the latter part of the sentence, "or results from the use or distribution of any and all Programs and/or Licensed Software".   If an implementor were to do a derivative of the RI then they would be indemnifying Sun.  Hence, we feel that the terms are too broad (and would include IP).

In Paragraph 5.1, last sentence, we do not believe that implementors should be asked to sign an agreement that states, "You agree that Licensed Software contains Sun Trade secrets."
